No worries. I got a whole closet full of nicely sized shoes.
Any private business open to the PUBLIC (ie. droned out casinos) cannot have a criminal trespass enforced against an individual without GOOD CAUSE (Disruptive or Disorderly conduct). You will never go to prison for being thrown out of a casino for legal advantage play and then returning because it's simply unconstitutional 'as applied' to the individual. 'As applied' constitutional issues must FIRST be raised in DISTRICT COURT (trial court) to have it thrown out. You CANNOT raise it on APPEAL This is the best kept secret in the world of casinos not just in Vegas but everywhere in the country. Thank me later.

It's clearly a failed policy, that's a shame, but what do you expect from that little man. Even when there is evidence the money has nothing to do with their fantasies of drug proceeds, very little rights. You might have guess Trump might transcend the politics ending the drug war, but the money made is too much to do the right thing.

Nope. The policy is working as intended. Law enforcement helps itself to whatever money it finds on the little people who cannot fight back.

Currently in America the dollar value of asset-forfeiture money seized each year totals more than the total amount of money stolen in burglaries. Money is the crack cocaine of the privileged, rich, and powerful in this country. And, law enforcement has now become addicted to this income source. So, brace yourself. It is only going to get worse, at least until we can get some responsible adults in the Legislative and Executive branches of government.

There was a front page story on this in the Detroit News paper today. Lawmakers here are trying to make it so there has to be a conviction in order for it to be seized.

Good point. Some states (far too few) have that provision now.

We'll see whether or not such policies continue to take hold. Clearly, Washington wants states to get with the program, because when law enforcement seizes the little guy's money, all the big guys win.

I expect it to get worse before it gets better, but I champion those states that want to establish sensible limits on civil asset forfeiture regulations.

The original point of seizing the money and assets before a conviction was so mafia kingpins and drug lords couldn't spend gazillions of dollars on lawyers.
Then it became a negotiating point. Plead guilty and we'll let your wives and kids have some to maintain a decent livelihood. Now, however, it's run amok.

Heres the secret and the step by step on how to handle this. I was going through this same situation of anxiety and stress before heading out here to Vegas cross country in my car with 23k in cash.

First off always have some type of recording equipment in the car. Secondly, put the cash in your shoes under the insole inside a sock and always be polite with the cops when he pulls you over. They will try to ask you trick questions at the end about whether you got drugs or money in the car. Dont try to be a smart ass but also try to make sure you stand your ground and he knows you know the law and wont get railroaded easily. Dont immediately say 'Am i being detained or am i free to go?" Just be like no sir theres nothing in here, i keep all my money in the bank and i dont do any drugs. Also keep in mind if they try to railroad you and illegally search your car, just continue to be polite and say, "No sir, i do not consent to a search". Dont ever raise your voice or act like a smart ass with your tone.

Now heres the important part and what many people dont know about. If they continue to try and railroad you and your rights and say theyre gonna call in a dog to sniff your car, heres the thing. IF THEY DONT HAVE THE DOG OR DOGS WITH THEM ALREADY AT THE TIME THEY PULL YOU OVER, THEY CANNOT MAKE YOU WAIT ANY LONGER THAN THE TIME IT TAKES THEM TO WRITE THE TICKET FOR WHAT THEY INITIALLY PULLED YOU OVER FOR. This is because of the U.S.vs Rodriguez Supreme Court decision in 2015 where the court stated that the cops cannot make you wait any longer than the time the traffic ticket takes to write for them to call the search dogs. And guess what? Cops 99% of the time never have dogs with them at the time of the stop. If they have the dogs with them already and get the dogs to do a false hit on the car and makes you step out of the car, this is where having cash in your shoes pays off. Cops never ask you and are NOT allowed by law to do more than a frisk search of your clothes. They cannot tell you to remove your shoes.

Follow these instructions and youll never have any problems getting your money seized.

I dont think your plan would work. What are you going to do, leave without your drivers license? Those hillbillies dont give a hoot about laws and courts, they know they're wrong, and they can get away with it. If anything, maybe you just shouldn't pull over for them, call the police and tell them you don't think the local yokels are legitimate police and hope to get state police to take over. I'd really like to hear a good plan even if I'll never be subject to a seizure because ill never travel in the south. Maybe trying to get a lawyer out there and having him take your money as a refundable deposit. Problem is the lack of rights and burdens, the police can take your car. No matter, I dont think there is any creative plan that can really outsmart them or people would talk about one.

So how long does it take to write a ticket 5 minutes, 10 minutes?
So after said amount of time you just start driving away,I can see a lot of problems with this.
We know what the law says, but whether the police follow the law is another question.
Even if they seize your money illegally you have to go through the hassle and expense of getting it back.

Leaving a traffic stop before the Officer tells you that you can, and while he still has your license will result in your arrest and your car being both searched and impounded. In jail, they will discover your money in your shoe, and if they are in a good mood they might let you kiss it goodbye. Any more great advice for your subjects, oh mighty king?

Its unbelievable the amount of assumptions people make with everything i say. When did i say i would just take off after the ticket was written? Its almost as if people just purposely think of something to argue with me for the sake of arguing. I obviously wouldnt just take off and throughout all of what i said, i said to STAY POLITE and that means NOT taking off. If you keep reading past the part about the dogs you can clearly see i then mention, if they still CONTINUE to railroad you and try to search you as in keeping you there regardless and get the dog to make a false hit, this is where having cash in your shoes protects you. No matter the railroading they try to do to you, the cash in the shoes will prevent any seizure no matter what because by law they cannot and will not and NEVER do ask you to take your shoes off. Now the question becomes what if they continue to violate your rights and tell you to take your shoes off as well. Problem is no cop will be that stupid because once youre outside the vehicle their own police camera is on you and they wont take any chances.

IF THE POLICE SEARCH YOU:
 A “search” is any inspection of your person that goes beyond a “frisk.” This includes going into your
pockets, any bag or closed container you are carrying (including a cell phone), feeling inside of your
waistband, taking off your hat, and removing your shoes.
 Police may only “search” you
o If they have “probable cause” (more evidence than “reasonable suspicion”) that the search
will reveal evidence that you committed a crime, are armed, or are concealing contraband;
o If you consent to the search;
o If they have a warrant; or,
o If you have been arrested.
 You do not have to consent to a search of your clothes, your home, or your possessions. Say
politely, but loudly enough to hear, “I do not consent to this search.” This can help if the police didn’t
have a legal justification to search you and then try to use what they find against you in court.

In short, if they feel like they have a reason to search you, they will come up with one.

What's this?

Railroading is a predetermined outcome. In legal cases, it's a judgement before a trial, basically ignoring evidence, just doing everything in their power to get the result they want. That's my understanding. A railroad has a beginning and end, no surprise where it ends once it starts.

Just curious how much of your cash you were able to fit in your shoes. I wear size 15's and doubt if I could fit much cash and drive across country and/or walk/stand without raising suspicion or appearing off balance. So, how did you do it?

Totally overlooked by media was Philando Castile, 32 year old cafeteria worker shot and killed by a cop last year had been stopped 46 previous times without a ticker ever issued. If police want to stop you, you will be stopped. Driving too careful, too slow, takind a wide turn, whatever 46 DWB's. Think any white man in Minnesota can match that record ???

Are you a minority?
If not, then your results may not be totally relevant.
I have a friend who is Hispanic and he follows the driving laws religiously, and he has been stopped multiple times, and had money confiscated twice.

I'm super white. I don't know much about my family's heritage so I ordered a DNA test. 100% European ... not sure what I was expecting.

My other white friends get pulled over though. I honestly just think it's because I'm an overly cautious driver. But I do believe from stories I've heard that driving while black has been a problem for a lot of people.

Most of the time, the mistreatment by cops towards blacks on TV and even as far as unfortunately taking the life of one of them at a traffic stop etc., are not because cops are bad, racist or in the wrong, but because these entitled and insecure African Americans feel the need to always talk back to the cops with an attitude and not follow orders. Even though the african americans are in the wrong initially by talking back and not following orders, cops are also in the wrong and need to learn how to handle the situation better and not always result to shooting or potentially killing one of them.

At the end of the day the African American race is very 'insecure' and they feel like they are not being treated equally so they act the way they do because of that. They are looking for equality and feel everyone is out to get them when the opposite couldnt be more true. Most of the violence and ill will towards them is self inflicted due to them being so insecure about being treated so differently. If they all just woke up and said "Im gonna make my race better, I'm going to get a good job, pull my pants up, take off the doorag, start acting like a reasonable person in society, and realize im more of the problem than anything, all these cop killings etc would end. Of course there's still a slight bit of racism going on, but most of it is self inflicted sadly and the african american race has failed to realize that.

I'm about as white as it gets and I've been pulled over for having out of state plates and having window tint that was too dark for the state I was driving through at the time. Didn't get a ticket for either one of those, though.

But I'm just curious why, if you're not doing anything illegal, would you find it necessary to travel with large amounts of cash on your person when it seems exponentially easier and obviously safer to just do some kind of bank transfer or use a money order/cashier's check?

This has been mentioned before, but bank transfers, money orders, casino credit etc..
Aren't convenient for many Ap's .
You arrive in town at night or on a Sunday the banks are closed, you can only get a limited amount from the Atm.
For many reasons we don't want the casinos to know our name.,so casino credit is out.
This is why we carry cash, nothing illegal about it.
I carry documentation, recent w2gs,a letter from my accountant, and from a lawyer, copies of my last 2 years of tax returns.
I have been questioned by tsa twice ,and state police were called, but after explaining why i had the cash had no further problems.

Which goes to prove knowing the ropes and being prepared is always good. However...

Though, I still occasionally I like to think it is still a free country, and just because I have a big wad of cash in my pocket doesn't mean it is ANYONE'S right to know what that is about if I am otherwise not done anything illegal.

This last part is what irks many of us. Not that we couldn't be prepared, but who the hell thinks they should have the authority to so easily confiscate OUR cash and make it difficult or expensive to retrieve on so little pretense?

Yeah, the point is more WHY SHOULD WE, than can we, IMO.

The laws definitely need to be changed, some states have done so ,others like New Mexico changed the law but continue to ignore and violate the law .

If you travel to many other countries you appreciate how much of a police state we've become.

I was in Lisbon for something like spring break. College kids packed the streets so tightly that it was hard to walk.

I saw one cop. Unarmed. Probably weighed 140 pounds. Standing there smoking and watching with a smile.

On the other hand, you perhaps you would have needed more cops with American kids.

Most of the time, the mistreatment by cops towards blacks ... are because these entitled and insecure African Americans feel the need to always talk back to the cops with an attitude and not follow orders. ... At the end of the day the African American race is very 'insecure' and they feel like they are not being treated equally so they act the way they do because of that. ... Of course there's still a slight bit of racism going on

Oh, Zen, you are sooo out of touch with the America in which Blacks (and other minorities) live:

  • They do not always talk back to the police.
  • They are not being treated equally, and study after study documents the ongoing one-sided application of "justice" and social equality in America.
  • There is lots, LOTS more than a slight bit of racisim in America, as evidenced by gerrymandered election districts, red-lined home mortgage areas, suspicious treatment at any department store, and so much more they have to endure on a day-to-day ongoing basis.

Where I live, we have a black congressman. Well-known former college football star and very successful insurance agent. His college-age son drove a late-model, upscale car and was frequently stopped by law enforcement (because why would a black teenager be driving such a nice car if he had not stolen it?) He had to carry a special phone set to automatically speed-dial his dad, so when the officer came to the car window, the boy could say, "Here's my license, officer. I'm the son a Congressman. Would you like to talk to him now?" From the law enforcement standpoint, this is not mistreatment. But, from the point of view of the black driver, when stuff like this happens every week, it is mistreatment. And, this treatment is common in the black community, but few are the son of a congressman, so their mileage varies.

IMHO, if you -- YOU, of all WoV members -- had to spend a year walking in a black person's shoes, your posts about all the racism they live with would probably make your posts about crooked casinos pale by comparison. People who think blacks get what they deserve because it's always their fault have a very misguided understanding of the world in which so many blacks and other minorities live.

Well, I was talking post traffic stop not pre-stop. What you say is true, they get pulled over more. Im not out of touch with the world. For example if a black guy is driving through a white surburban city, hes likely getting pulled over, especially if his car is beat up and it's at night. I was just talking about post traffic stop where the black people get in trouble. They like to stand their ground and not follow orders most of the time and thats where things get ugly. I understand the frustration though if they are getting pulled over through assumptions and misconceived notions just cause of the color of their skin. It's unfortunate, but for this to change, all the black people need to gather together and fix the hood people to act like normal people and not thugs with hoodrags and their pants falling down their legs. I dont want to get into an argument about blacks vs whites because im not racist and im not discriminating against anyone, but go look at poor white people and go look at poor black people. You see the difference? Blacks need to do a better job within their race to grow their culture. Cops also need to do a better job to not pull people over and mistreat someone just based off assumptions because of the color of their skin. Sad times we live in.

A police state is never a good thing. Let me guess, you're pro removal of 2nd amendment? Let's take away all the guns from the innocent people and only have government with guns. Yeah that's the ticket. God i wish i was born in 1776 or the early 1800s. Bring me back to the Thomas Jefferson days when society was full of educated citizens about their constitution and how to prevent government from over reach. What we have now and im not saying you per se, but all we have now in society are a bunch of mindless drones who go through 90% of their day with their head down looking at their phone. People cant even cross the street without looking at their phone. I wonder how many people in vegas that i pass by on the daily, has read any part of the constitution of this country. But go ahead and ask them who kim kardashian is dating on the daily and they'll have the answer to that. How the hell did society get this pathetic? Ill tell you. Media and TV.

+1. Us white folk don't understand how frickin' lucky we are. People of color get treated very differently in all corners of America simply because of the color of their skin or the way that they talk (their accent). I have driven well over 400,000 miles in my lifetime, and have been pulled over only for legitimate reasons (speeding) a handful of times (less than 5). You will see cops pulling over people of color for stupid reasons (busted headlight, improper signal, driving too slow, illegal stop, safety issue etc) that a white person would never be pulled over for.

Which is what I've posted before, and that youth don't understand (and I will put my own daughter into that camp) is how lucky they are. This summer, my kid got to go to the south of France for a credit course offered through her University. I paid for some of the course. So, here she is in the south of France, and she writes me to tell me that she feels trapped and that the course material is too hard. Boo freaking hoo. I told her that if she wanted to leave she could pay the $1100 in airfare/train fare and pay me back for the course that she dropped. She writes back and says that I just made her feel more trapped. I feel nothing for first world problems like these where the subject doesn't understand how incredibly lucky they are to be in such a circumstances yet manages to make their own personal hell out of it anyway.

Not realizing how incredibly privileged and lucky he is to be able to waste one's life on doing something so mundane (using 4th grade basic math skills when you have a college degree) and selfish (providing no benefit to anyone except yourself) is incredibly foolish. But hey it's his life. Rather than understand how privileged and lucky ZK is, all he can do is theorize about Chinese decks, the fact that he feels cheated by CZR and that he can't see any reason to tip because he doesn't agree with society's norms yet take advantage of everything else that those societal norms offers him, including playing at casinos where tipping based on service is a societal norm in North America.

I feel damned lucky each day I get out of bed with my rented home, fantastic health, great job, and my beautiful white skin. Feeling any sort of depression because you lost $1,500 (or 15,000) in a casino is short-lived and really, for me, un-allowed. It doesn't mean I am happy all of the time. It means that when I am feeling blue, it is really because of stupid first world problems that are brought on by others (aka marketers) setting standards for my 1st world existence on what my life should be like.

Let’s not blame it on the victim, but blame it squarely on the bad or poorly trained cops.

Challenging or questioning authority is not the same as disobeying the law or the authority, and it is NOT a sign of in-security or entitlement. It is all about mistrusting of authority, and mistrust of authority can be attributed to their decades, centuries of life experience of mistreatment, discrimination, harassment, and unnecessary racial profiling.

It is normal and appropriate for people to challenging or question authority when they felt or suspected that they were mistreated. After decades, centuries of mistreatment, discrimination, harassment, and unnecessary racial profiling, African American should and have every right to challenge or question authority of cops, and their action is a form of check-and-balance of police power, and the society owns them a big thank you. And such action is no different than other forms of peaceful civil disobedience or protest against the government, the racist, sexist, rapist, scam artist, and con man Trump, or any other politicians.

Questioning police authority and peaceful protesting are one of many ways to keep the power of the government in check and should be welcomed by all, and they deserve support for performing their civic duty.

Let’s not blame it on the victim, but blame it squarely on the bad or poorly trained cops.

Are black people more likely to commit crimes involving a vehicle in some way? Because that would be the only reason it would make sense to pull them over more often. If blacks were more likely to commit, say, robberies or gun crimes, pulling them over while they're simply driving to the store or to work and not actually in the midst of committing one of those crimes doesn't make sense.

Cop: "Hey, look... the guy driving that car is black. He's more likely to shoot his neighbor in a drug deal gone bad. Let's pull him over and give him a speeding ticket."

Huh?? What good does that do?

That's how my brain works in this situation, but then again I'm not black or a cop.

I don't know how black are you, but I can make a reasonable guess based on the publicly available statistical data that you are much more likely to become a victim in the hand of bad or poorly trained cops or other social injustices than a typical white person would, and expressing yourself as a partly black person does not diminish the significant of such statistical data.

So you are a product of mix-race marriage, and how black are you? Well, here are my questions to you, do you look black enough? With a quick glance at you, can anyone see the blackness in your inner soul and outer appearance? Can you be easily identified as a black man at a distance of 10 to 20 feet away while speeding at any legal speed limits of 55, 65, 75 mph? Are you 50% black, 1% (no, I'm not talking about the 1%er in the wealth category of the racist, rapist, sexist, scam artist, and con-man Trump, or Romney) black? What do cops think of you, me, or anyone's reading comprehension?

But even if you answer all those questions as yes, your lack of concern for the basic civil liberty and the rule of laws expose the selfish attitude in you. Although you haven't experienced any of these "racist" stops or DWBs, but the fact remains that bad cops or poorly trained cops could make your life or the lives of black, partial-black, or non-back miserable should be a concerned for all.

If the money is in your shoes why not let them search the car, at least they will be distracted from your shoes? IMO. If you have been polite and happily submit to their request to search your car (assuming you have nothing illegal in the car) they will just let you go on your way thinking you are probably a good citizen.

Here in Vegas, I have been asked 3 times if they could search my car after being pulled over. I always say, sure go for it. Each time, I should have received a ticket for a moving violation. It seemed to me that since they didn't find anything in my car, it's as if they made up for it by forgiving /forgetting about my moving violation.
