Last January, police pulled over 63-year-old New Mexico resident David Eckert because he didn't make a complete stop at a stop sign while exiting a Wal-Mart parking lot. When he stepped out of the vehicle, police notice that he appeared to be clenching his buttocks, so the police brought in Leo, the drug-sniffing dog. Leo alerted police to the driver's seat which apparently smelled like narcotics (at least to Leo.) Against his will, Eckert was taken to Gila Regional Medical Center in Silver City, New Mexico and here's what happened next:

1. Eckert's abdominal area was x-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.

3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.

4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

7. Doctors then x-rayed Eckert again; no narcotics were found.

8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon, and large intestines. No narcotics were found.

Leo, the drug-sniffing dog, has made this mistake before. Nevertheless, earlier this year the U.S. Supreme Court ruled unanimously that "a court can presume" an alert by a drug-sniffing dog provides probable cause for a search warrant, regardless of an individual dog's track record of accuracy in the field.

The Gila Regional Medical Center has billed Mr. Eckert for the “services” it provided without his consent (two forced X-rays, two forced digital penetration exams, three forced enemas and a forced colonoscopy) and he still receives medical bills for thousands of dollars for these "services."

David Eckert is suing.

Thats odd...he must have been driving a real snazzy vehicle though...the cops probably really wanted to seize the vehicle not the old coot anyway.

I believe the basis of the lawsuit is that the search warrant was executed in a different county and therefore the cops made a mistake as to jurisdiction.

There are many such victims that don't sue or make the evening news.

And no one really knows what an "alert" is... dogs do sit down of their own volition unrelated to a drug search sometimes. So did the dog just issue an alert or did he just feel like sitting down? You want to ask him? Go ahead .... you will get a more intelligent response from the dog than from the cops.

I disagree. If this goes to a jury trial, there is no way the jury doesn't side with him. I think it is down right awful that the police think they can go through all of this torture. I could understand an r-ray and maybe an enima but all other things especially a colonoscopy was out of line.

The items omitted in the story are that the search warrant was only for the County that the incident took place in. The police had Eckert taken outside the county to perform the probes. Also, from my understanding the warrant was only good until 10 p.m., and the probes took until past 3 in the morning the next day. I think Mr. Eckert my have a good case.

In this country, they can perform a traffic stop, sniff your ass, and probe your ass based on a warrant, LITERALLY.

Why oh why can't some good civil liberty lawyers get that to the Supreme Court, because that pretty much sucks.

Apparently Leo and the deputy sheriff have tried to nail this guy several times before. As near as I can tell that's the third false hit Wonder Dog Leo has signaled on Eckert's truck. The deputy finally got to see Eckerts ass**** and pick through his s***..... maybe now he will leave him alone.

When I read this story, I thought to myself that something doesn't add up. With all the facts as presented, it's a terrible injustice and a deplorable civil rights violation, but all the facts just don't add up.

I knew a landlord who found this out the hard way. Cops raided a house because the renter was dealing drugs out of it. Busted down front and back doors. Nobody notified landlord. Cops left and people stripped the house of plumbing and all appliances. But cops did have time to look up the records later when they notified the owner they were going to seize the house.
They was one case somewhere ( I forget where ) but cops seized house and evicted kids because Dad shot Mom and himself.

Anyway, here is another story wherein it is revealed that the officers knew him to hide drugs in his anal cavity in the past.

Given that information, I am less sympathetic to the guy. But given the issues with the search warrant (wrong county and expired), I wouldn't be surprised if he gets something out of the suit.

It looked like to me he was a petty criminal with several charges dismissed by the prosecution. I couldn't understand what the paraphernalia was, although he was charged for meth.

They x-rayed him which showed nothing. This violation of a person's rectum is far more heinous a crime than a little bit of dope, in my opinion. The ends did not justify the means. I'm not looking for any dealer to get rich from a law suit. It can get a lot more up close and personal when a person is completely innocent and they already have precedent set for all this anal stuff. How horrible to have happen to you or a loved one.

Colonoscopy's aren't entirely safe either. This is some sick perverted stuff here.

No, only that the officers CLAIM that they had such knowledge.

FleaStiff hit it correctly below, the article shows a screenshot wherein the officers CLAIM that they knew he had hid drugs in his anus in the past. So that is pretty flimsy, I agree.

Yeah,,, your right, unless he can get a rectum rebuild which should be at the top of the settlement agreement. Any lawyer worth his/her salt will clearly see that a rectum rebuild is job one.

You just can't imagine the humility. When they sew you back together they go in the back with a circle stapler with titanium staples and go thru the belly for the anvil part of the stapler. When you sort of heel up but leak out the back every where you go, you think there would be some sort of guarantee on their work but you'd be hard pressed to go in for the warranty.

Look what happened to Don King. No offense to the lawyers but usually a case like this an attorney will have to take the case pro bono, and they end up with half or so. Then the guys friends and family want their cut for standing behind him the whole time and after a celebrity party if it don't get busted there really isn't a lifetime of hookers and blow money left.

And after all that, he still leaks. Better off if he just stuck with something safe like alcohol in the first place. [sarc]

It's got to be heartbreaking to to be around the dogs that will only alert on Big Macs but never the evil weed. They must be full of shame. Apparently only 1 out of 100 dogs are worthy to join the CRUSADE. What about the poor rejects? Who's tending to their needs? I'm guessing a fair percentage end up in the city dump.......victims of the WAR ON DRUGS.

I'm guessing the officers or "first responders" suffered no repercussions. They probably think it's funny.

He probably got rectum rebuild as part of the settlement.

I'm afraid that Eckert's windfall will be his undoing.

Leo is dead. He was a horrible drug dog and taken to the pound as a result.

Funny how cops and their departments are never wrong. Ever notice??? "We did it by the book". "All the protocols, rules sand regulations were followed", "After our extensive and exhaustive investigation of all the facts, we conclude the officer(s) did nothing wrong", Etc., Etc. Gee, how about the truth, "I/We made a mistake and killed your innocent 12 year old boy on the swing", "A mistake was made and we over reacted", "It's the horrible truth, we just messed up", Etc.
Bac79=Hazardous Material and Chemical person correcting other's mistakes. Non AP'er, I can't count cards, low intelligence. Sprinkles magical dust on the cards. Has a lucky monkey. Baby also has a green one. Sum it up: "It's okay just blame me, it's all my fault"! ( No one believes me--so I chose to stop posting)

That would be infinitely more acceptable to me. I know mistakes happen. Anybody who has done much of anything also realizes it as well. The lies, just like the lies that the government told Pat Tillman's mother are revolting. The kids are dead just the same, but loving family shouldn't have to bare the indignity of being lied to like they were idiots to be disrespected. Often the truth or parts of it come out, and then the family has to suffer it all over again with a revised explanation. After the falsehood perped on the sufferers, they don't know if and when they can know they aren't being lied to again.

I might add, I spent numerous years in the NYC (all parts including the South Bronx and East New York/Bkyln) I don't say use of force is wrong, but if you witness 20 cops on one subdued individual or 20 cops taking one individual down, you might think otherwise. Sure, and I agree---the boys in blue deserve to go home at night, but where does all this lead???? For one, the attitude years later after heavy handed policing tactics, to violence on police officers that didn't do anything to deserve it. One comes to mind, the two innocent officers sitting in their car in Brooklyn when the deranged killer came up from Baltimore to "kill some police officers". The saga will continue for a very long time.

I know what the streets are, I spent lots of time in and around Paterson, Camden, Passaic, Newark and throughout the 5 boroughs.

I hate to say it, but you have to lie and cheat in some way like the others to survive. Let all the crooks and killers run free then so that we may kill them in the streets. Skip the government baloney. Let them get jobs like the rest of us, and live with their own decisions. Assume you are being lied to.

No cop I know lets a person just walk up to his car. Slow cops waiting for the government to help them.
