Depends on the specific state. It's a bit dated, but I did a WoO page where I looked into all of the individual state laws once.
The UIGEA (Unlawful Internet Gambling Enforcement Act) is what led to the misconception, but all that really did was state that U.S. based financial institutions, which mostly just means banks, could not KNOWINGLY conduct financial transactions with offshore casinos.
Somehow, that led a great many people to the conclusion that playing at offshore casinos is illegal. Obviously, it's illegal to OWN or OPERATE an unlicensed online casino that offers its product to citizens of the U.S., but offshores are out of jurisdictional reach for anything to be done about it.
