I searched google and this forum and didn't find a satisfying answer to my question.

-Dealer Bust

are they public domain? or trademarked/patented?

Super Sevens looks trademarked by SHFL/Bally but not sure about it.

any answer is very much appreciated.

I'm quite sure that over/under 13 has been around over 25 years and would thus be in the common domain. The other two likely have some kind of protection.

More likely than not, all side bets have some type of protection. As the Wiz points out, over/under 13 is simply old enough that the patent expired.

You're gonna keep looking? Good luck. The problem is, often the name that is used in the casino is not the name used on the patent. Also, if it was done by an independent, they may not have a good website, so you might not find what you're looking for - even if it exists.

to be frank I can't believe that someone will get a patent for a streak bet or the dealer bust bet. he could get a trademark IMO. but a trademark is not a patent
and a trademark in this case could be circumvented. but as I want to be sure about it I will go on searching :)

There are hundreds of patents for games that fail. Hundreds more for games that never even get a field trial.

So don't be surprised that there are patents for the games you're asking about - even if you fail to find them.

Dealer Bust 21 is now being distributed by AGS. See their website here: AGS. I would guess that AGS will vigorously defend rights if they know you are using the bet. It was previously owned/distributed by Barrett Gaming International, LLC (they likely entered a distribution deal with AGS).

Streak is owned by MAO Gaming. Didn't think it was in play anywhere except Buzz used to say it was up in Blackhawk, CO. May still be in play there. Haven't ever seen it live in person at a B&M casino.

thank You for the input. Dealer bust 21 has a copyright symbol next to the name. need to check if that is all they have. I meant the dealer bust that is mentioned here

I would look under Barrett Gaming International at the USPTO, they are likely still the holder of the Dealer Bust 21 IP. It is an old enough bet that I would assume a patent was issued. I would be shocked if the IP didn't cover paying a player that makes a bet that the dealer will bust. The pay table is irrelevant in most IP claims. They have several that go along with their version of the game where a player bets on the dealer busing their hand.

Bet one of them has an infringement case against the others although there are some subtle differences in that Buster Blackjack uses a number of cards mechanism, Bust Bonus pays based on the original dealer's upcard, etc.

I didnt find any trademark/patent for the Vienna casino BJ bust version. for me it looks that I could use the Vienna bust version and the over/under 13

There can be protections for the 'name' of a side bet as well as the side bet itself.
There can also be design protections on typeface, colors and images even if the bet itself is in the public domain.

If you think you are stepping into a mine field, get help early on.

thanks for your posting. to be frank I cant understand that someone can patent,trademark a bust in BlackJack. a bust exists since BlackJack was born. on a website it is quite easy to offer "bust" without any colors or even an own field on the felt.

and what kind of early help do you mean I could get after stepping into a mine field ? :)

The patent would be for something like "a game that pays according to a paytable when the dealer busts", not for the bust itself.

yea that is what I thought. for example the Vienna side bet is that a bust is paying 5 to 2 ........how could this be patented. IMO they could trademark or copyright a logo and/or a designed field on the felt for this side bet.

This is how......it isn't really a mystery: Dealer Bust 21 Patent

This is specific to a computer implementation of the bet (e.g. online version) which is all that has been getting allowed by USPTO recently. Look for AGS' correspondence from their attorneys upon your implementation. Good Luck!

will give it to my lawyer to review it. it looks that it is a US patent only. in Austria/Vienna they offering the bust that would explain that it is US only patent. lets see what my lawyer will say.
