It’s a good first step. Not yet a game changer though. It’s application of the “no excessive fines” provision of the 8th amendment to the States. States can still seize like they do today as long as the seizure isn’t an excessive fine. For sure it’s another argument that the defendants can use to get their possessions back, but it’s the same paradigm and we will see how jurisprudence develops around what constitutes an “excessive” fine.
The race is not always to the swift, nor the battle to the strong; but that is the way to bet.
