I don’t think most people understand how many people are hurt when someone hires an illegal. And I wonder how many if they did, might change their opinion. And I’m a firm believer that employers need to be punished, up to and including jail for their crimes. Which by nature includes Tax Fraud.

Here is how it works in the restaurant industry as I’ve observed for the past 40 years.

Owner hires an illegal and pays them a cash wage less than market value and preys on their fears so they work for the lower wage. And the owner doesn’t have to match SS wages, saving $’s and shorting the system. They also don’t have to pay workman’s comp insurance since those rates are based on reported payroll. So where does this cash come from? Why from sales of course, sales that are never reported to the State Government, therefore they don’t pay Sales Tax in it. YOU the customer paid the tax but the owner doesn’t report it so he just made an extra 6% (PA) on your purchase. And of course that money never makes it to a P&L so the enterprise appears to make less than it actually is, again cheating the Government of Federal Income Tax.

Now just how does this restaurant explain purchasing so much food and not reporting the sales that should occur from this amount of purchases? Because there are vendors that also accept cash for a portion of the weekly invoices, therefore allowing the restaurant to keep margins in line with what the government expects to see.

So instead of needing $18,000 in weekly sales to justify a $6000 Food Purchase assuming 33% margin, they pay $3000 in cash. So now they can report $9000 in sales and everything seems fine margin wise.And with the cash paid employees, labor seems in line for $9k in sales. And they just pocketed over $2k a month in Sales Tax paid by the customer.

These criminals business owners hurt competitors who play by the rules by having an unfair advantage in all of the above categories. By no means am I blaming the illegals for this entire issue because there are plenty of legal citizens doing the exact same. And collecting benefits based on their (lack of) income.

The only good thing is that the increased use of Credit Cards is eliminating the cash these business owners have access to and is making it harder for them to pay cash to employees. Making it easier for the IRS to find discrepancies through algorithms by industry. And leveling the playing field for those of us who bust our ass trying to do the “right” thing in following the law.

In the end all of us that pay taxes are being hurt by these scams. And while illegals are not the entire problem, they are part of a problem that affects all of us. It’s a guarantee the person hiring them is a tax cheat and you are only contributing to it by patronizing that business. And he or she deserves jail just as much as the illegal they hired.

The big, shiny wall won't fix the problem...but neither will ignoring the problem. It is a combination of things that we haven't been able to figure out for years.

This President is only the latest to not get the job done, so far, but it also rests upon a Congress that term after term is seemingly unwilling to force any President's hand.



Doing nothing doesn't solve the problem.
Throwing money at a wall doesn't solve the problem.
Perhaps throwing the wall money at something else will.

The crisis at the border won't be solved by a wall. People aren't sneaking in, they are turning themselves in, asking for refugee status.
Take the money trump wants for the wall, do a surge on Immigration judges to eliminate the backlog and send home the people who don't qualify.
If a Guatemalan kid leaves home to go north and isn't heard from, other kids follow. If the same kid ends up home a month later after coyotes took his savings and he tells everyone refugee status is a pipe dream, maybe they stay home.
Right now, spending months in a detention center in America is safer and healthier than staying home. When jail is the better alternative to being home, we have a problem.

I would not have said deported as you cannot deport a citizen.

But it is time to do something on the employer end as well. Even if just club fed.

Will you now feel different about the work. Do you feel horrible that the wonderful job done on your house may have been performed by illegal immigrants?

Important question here: If true and the cost to do the work was 20% higher if handled by legal personnel would you have been willing to pay the extra cost no questions asked?



I pay the going rate for all services and products I buy. I am all for only people legally here being able to do the work, and let the prices be what they may. You realize that the under the table payments to illegals mean no FICA tax collected, no Medicare tax collected, no Federal or State income taxes collected? Who do you think makes up for that? ME! When they show up at the emergency room, who pays for their care? ME!

I may or may not have hired illegals many times from Home Depot. If I were to hire someone for whatever reason, such as, painting, digging or moving something, I wouldn't ask them to show me their green card. I would just ask them if they had a drivers licence and spoke English. Good enough for ME when I need something done I don't want to do. Given the right circumstances, I don't even think I would care if they had a drivers licence or spoke English. I watched a few cartoons and I might know a few Spanish words like... andele


I still want a wall and less mexican people immigrating into the USA. Call me a hypocrite, I don't care.

So just curious.

You need a car engine repaired and the mechanic offers the full price but says if you pay cash with no receipt its $300 cheaper?

You refuse or accept his deal?

I know very few who would refuse so again just curious.

Ignore any aspects of illegals doing the work. This simply about Fica and all the rest of the issues you raised

One "gotcha" question after another. I admire your attempt to trap people into saying that they would willingly help someone break the law, while possibly breaking it themselves.

I pay my taxes while keeping them as low as legally possible. Do you willingly pay extra?

I have renegotiated my terms of employment due to changes in the tax laws at various times.

I don't accept deals like "we will replace your roof and won't charge you the deductible"...

You say nothing about how to fix the immigration question; instead, just ask "gotcha" questions. What is your position on the immigration issue?

This was a really great assessment of how illegal immigration hurts everyone. It shows that the only way to stop these damages from happening means a more secure border, more enforcement of labor laws, and clearer paths to legal immigration. Without all three of those things, it will be impossible to stop any of these problems from happening. Virtually every politician in Washington wants only one of those things -- Trump wants zero of them.

I just had work done on my house. I wrote a big check to "Joe's House Repair". Should I in any way be responsible to check if any of the workers Joe hired are not legally here?



There is a difference between home repairs and a business. We could easily have laws that says any business must do some sort of e-verify for anyone they hire. We could then very easily extend that law to include any contracted workers. When I did contracted work like that years ago, it was common to have to interview with the client even when they had nothing to do with my paychecks.

I know it was illegal to feed homeless people in parks.

Suffolk Country tried to use anti-prostitution laws about soliciting to go after drivers trying to pick up day workers but it wasn't successful.

It might be illegal, in a particular park, to feed the homeless, but that isn't a widespread law.

That is most definitely a state law issue and not widespread

It is more common that restaurants cannot hand unpurchased food to the homeless but individuals who want to give out food can do so almost anywhere

More secure border = fencing as needed, drones, more people on watch, more judges

Trump is at least trying to do some of that--where all those other politicians that are trying to help him find a better solution?
