AGS's Vegas 3 has a community card that 3 Card Poker doesn't - that should make it different enough.

Is that all it takes is one community card. To get around a patent and get one of your own? It is just used for the vegas 4 optional sidebet correct? Did they get a patent on Vegas 3 before they changed the rules for table game patents in 2015? How about Jackpot Holdem?

If a single claim in a patent differentiates it enough it can be considered a different game. The claims in a patent are the only things enforceable.

In jackpot holdem the maximum raise is 3x (vs. 4x for UTH) and you can make a 3x raise after one of the flop cards is exposed. That makes the sufficiently different to avoid a patent infringement.

This is why I think a patent isn’t even really worth it, regardless of whether or not you can get one these days. You’ll spend an enormous amount of money for the patent and someone can find a way to easily rip you off anyways.
