I appreciate and understand the current issues surrounding online gaming and payment processing
That being said is it legal to "pay out" winners their winnings by check?

Of course it's legal. In some places it's probably even required. That way the payment can be traced and cancelled if there's a delivery problem. It's certainly better than stuffing a fist-full of bills into an envelope!
