I don't know what the official rules are, but the place I play at always renders the dealer hand if there's a relevant sidebet in play. (Offhand, I want to say it's FB's dealer 22 and a Buster bet on some of their normal tables.)

I'm pretty sure that whatever application the game made to the state (or tribe or other jurisdiction) required that the bet, if made, be determined regardless of the main game results. If the casino is not following through for any reason, they are likely not in compliance. A lot of times the distributor can intercede if the rules are not being followed, because the game does not comply with the approved HE if that's the case.
If the House lost every hand, they wouldn't deal the game.
