The DOJ policy is not to indict a sitting president but there is nothing constitutionally or under the law
Theoretically the DOJ can change their position just the same way they originally formed it.
If any president (democratic or Republican) would be safe from prosecution if in anger at a congressman or a reporter the president took out a meat cleaver and chopped him down, then laughed and yelled "cant convict a sitting president" you would see the DOJ immediately change their policy
