Carmen Brown of Arlington was waiting in line as the victim was being secured in for the ride. She said she believed that the woman’s son was on the ride with her. Brown said the woman had expressed concern to a park employee that she was not secured correctly in her seat.
“He was basically nonchalant,” Brown said. “He was, like, ‘As long as you heard it click, you’re fine.’ Hers was the only one that went down once, and she didn’t feel safe. But they let her still get on the ride.”
Somebody is gonna own an amusement park. Lawyers
all over the country are losing sleep tonight.

Quote: kmumfI'm going to guess that neglance plus her size had something to do with her "flying out". People are getting to big and breaking everything.
I'd give you even money she was under 275 lbs.
And hell yes, I'd wanna own Six Flags. I'd still be a millionaire after the lawsuit.

Wow that's a hard one looking at the photo she looks right in that range.

LOL...I didn't see a photo.
And actually, I was originally gonna say 300 lbs. but I changed my mind...lol
Here she was pressed against it and it flew open.
Strange. I guess the kid gets tired of people who express doubts.
Why? Because they didn't get the case?Quote: EvenBob

Were she deemed "too big," Six Flags should have prohibited her from riding.
I just hope some half-wit defense attorney raises her size as an issue; he'd walk into a buzz saw.

Of course. I knew a lawyer years ago who constantly
bitched about cases other lawyers got. A case like this
will have them crying themselves to sleep because
it didn't happen in their town.
Quote: MrVHer size has NOTHING to do with it, legally.

.
Thats it in a nutshell. The bigger she was the better.
Six Flags let her on the ride with their blessing, thats
all the jury needs to see.

Of course the lawyer from the park already
had the family on the phone within the hour
trying to give them a settlement check.
Quote:The woman was accompanied by two children, who were "hysterical," Kelley said. "They were saying that their mother flew out of the car."
"It was sad. It was very sad," she said. "We kept telling them to let them out because they were hysterical. The daughter and the son said, 'We have to go get my mom. We have to go get my mom.' We were kind of in disbelief, and we just said a prayer for her."

Quote: rxwineI have to admit, it probably won't look good in court for Six Flags. An out of court settlement, perhaps?
Like I said, the lawyers for the park are already
on the phone to the family talking settlement.
I had a similar thing happen to me, I got hit
by a truck as a pedestrian 20 years ago. Broke
my arm and wrist in 3 places. When I got home
from the hospital hours later, there were 5 calls
on my answering machine from the companies
lawyer wanting to talk to me about a settlement.
I went to court instead.
I wouldn't be surprised if they started discriminating by weight.
Quote: IbeatyouracesThere was an accident at Cedar Point the other day but I don't think there were any injuries.
They considered all 7 "injured", but only one of them was bad enough to go to the hospital.
I recall coaster attendants either pushing the bars in place or walking by and pulling up on them to see if they're locked. (in my limited coaster experience)
I am a 60 + year old male, and unfortunately fall into the "overweight" category. I spend way too much time on the internet, watching sports on TV, and shoving my favorite foods down my throat. I hate salad, and I'm not a big fan of exercise, but I try to take a 2-3 mile walk, 3 times a week. I'm on cholesterol medication and hypertension medicine.
Unfortunately, my situation is NOT uncommon in the lazy mans 21st century. In fact, it's the norm in today's society. People are breaking their joints and bones, because of being overweight.
HOWEVER, in this instance it seems to me that the Park and/or their employees are negligent. The persons weight did not make the coaster malfunction, as these types of rides are designed for extreme riding conditions. The weight if the rider did not make the coaster "break". The person inspecting the safety of the passengers prior to the ride starting is the most likely culprit. This was an avoidable accident. My thoughts and prayers go out to the victims family.
