So in order to deter shootings in bathrooms, we need to install cameras in bathrooms? I think the family's case is stronger with that element excluded from their complaint.

At least they're also suing the shooter. Of course he'll have no money when he's done paying his lawyer, and, one hopes, no time to earn more after sentencing.

How does that work? Do they get the liquidated value of his estate? Do they get the monetary value of his commissary credits if he works in prison?

What I meant, is that the shooter won't live long enough after his sentence to accumulate any significant amount of money.

Umm...it's strictly a procedural thing. Of course they don't expect to get any money from the deadbeat criminal. "Always sue the person with deep pockets" -- in this case, the casino/Fifth Street Gaming. But you have to name the shooter in the suit before you can add the other parties.

Always sue the tortfeasor even if his pockets are empty.

Many criminals know there are no cameras inside the bathroom and little chance that a security guard will enter. Also many bathrooms are close to entrances and exit doors for quick getaways. Bathrooms have become high crime areas in casinos.

Cameras often catch only the back of a person entering but they never capture the crime itself.

Premises liability is a quirky area of the law. The casino does not guarantee safety in the parking lots or bathrooms but should take reasonable steps however what exactly is reasonable. Its a high crime area (NLV) and just about everyone there probably has an arrest record ... well, maybe not. I really wonder if some night they could poll the casino patrons? Facial recognition takes time and generally only works against the few images that really matter. Few locals casinos could afford facial recognition software or even high quality cameras and decent lighting to obtain the images.

I'm sorry for the family of the guy who got unlucky but see no reason why they should get rich unless the casino was negligent and just how much would the casino have been able to do to prevent something like that from happening. Most members of the public do not want television cameras inside a restroom and just about every female would object to one. And what would a camera do? Prevent the crime? Cameras abound on the Bellagio casino floor, but someone walked in and grabbed high value chips at gunpoint. Cameras filmed the crime but surely couldn't prevent it.
