Hey Wiz, I have a few questions in regards to getting my BlackJack game into a Casino or card room. My first question is can I market it without having a patent on it? I heard a non-disclosure agreement would work but I'm kinda leary of that. My second question is while I'm waiting for it to be patent certified can I make money off of it at a Casino or card room? I have many more questions but these are the two that seem to be the most important at the present time. Thanks for you input.

Welcome to the forum. While you're waiting to see if the Wizard has any answers for you, I suggest you read back in this topic (under Game Inventors Corner); nearly everything you could want to know about patents and marketing has been discussed in this topic heading by a lot of very good designers. It will take you a couple of days at least, but it will save you both time and money to do so.
If the House lost every hand, they wouldn't deal the game.

Many people market games before a patent is issued but it would be wise to have the patent submitted and pending before showing it. Yes, you can derive income from it before the patent issues. Just be aware that others can copy it and use it until the patent issues. FYI, Table game patents for games are becoming much harder to patent.
At my age, a "Life In Prison" sentence is not much of a deterrent.

It varies widely depending on how much of the patent work you do yourself as opposed to having an attorney do it.

I suggest you read Elliot's book, he is a contributor to this forum.

Rather than teach a private course on Casino Game Marketing 101 over and over, please start by reading/watching all the sources listed here on this topic. You'll also see listed some good mathematicians and lawyers.

Thanks for the input and I really appreciate everyone's support in my journey to get this game on the casino or card room floors. This game is freak'n amazing!!! Its all God's work I give him all the credit for opening my mind to figure this style of BlackJack out. Once again. I thank everyone for their valued advice and hopefully I can pay you back one day.

Hi RedJacks,

You should definitely patent the game if you want it to be protected, if it’s not protected why would casinos pay you when they can copy it for free?
I highly recommend that you speak to Jon Muskin http://www.patentstrademarks.com/attorneys/jon-muskin . Don’t waste your money on a non-industry patent attorney. Non-Disclosures don’t always work especially with the larger companies. And the last tip I have is don’t disclose your idea publicly before you patent it otherwise you can face issues protecting it.

Definitely speak to an attorney. A non-disclosure is meaningless if you disclose your game rules to the public by putting it into a casino.
