Poker game

Abstract

A casino table poker game where all cards are dealt face-up and the dealer plays a hand. Players each place an ante wager and are initially dealt a partial face-up poker hand and the dealer is dealt a complete face-up poker hand. If the dealer's poker hand meets or exceeds a kick out threshold, the dealer folds her poker hand. The kick out threshold can vary based on the number of players in the game. Then, from lowest to highest rank of partial face-up poker hands, players can fold or pay an additional wager to receive additional cards to complete their face-up poker hand. The pot is awarded to the dealer or player with the best poker hand according to a predetermined set of poker game rules.

If true, this is what the industry needs. Could really open the floodgates for real games to get patents. For the sake of the industry, I hope so.

I know. Was shocked to discover this. Still in doubt, because I think such a change would have been posted online by now ?

im just having trouble understanding whats going on? is it because the dealer is not normally a part of the round?

It basically sounds like five card stud without a hole card. Except dealer/house gets all five cards first and either plays or folds depending on hand. Five rounds of forced betting to get to a showdown. Presumably the dealer/house isn’t betting or ante-ing which is where the HE comes from? Could be +EV game if table has some people at it playing sub optimally. Interesting table game dynamic as you are winning other people’s money not the house money.
The race is not always to the swift, nor the battle to the strong; but that is the way to bet.

Benjamin Layno was the examiner on my first Application with USPTO and he denied patentability based on Bilsky/101. I was told by another individual that Layno actually wanted to allow casino game patents to be issued but "his hands were tied". Maybe they have become untied...he isn't new to the casino patent art unit so this can't be some fluke issuance that just got through a poorly informed examiner.

One door closes and another opens. Hopefully this door has been re-opened. And any idea to circumvent Bilski can now be added
to a physical table game.
