It's legal, but uncommon.

The closest I was a part of was the Super Bonus in Spanish 21. A player received a pair of Suited 7's and the dealer had a 7 up. The table minimum was $3 and that is what he bet, but you need to bet $5 to qualify for the Super Bonus. I think it was decided that if he hit and got the 3rd suited 7, that everyone but him would get the Envy (even players who bet $3). He didn't get the third 7. :+(

I have never seen this done, and I have received many many Envy bonuses. Doesn't mean some place does this to people, but I can't say I would ever stay past the first unawarded Envy. What a crappy way to try and use peer pressure to force play of the sidebet.

It is EXTREMELY uncommon and wrong. I as a player am paying for the envy bet and should be paid no matter what the other players are doing. Whoever is doing it that way is not following standard gaming rules and if given an option you should not play there.

By the way... the house edge on the bonus bet on Texas Shootout goes up by 1% for every open seat or player they exclude from envy eligibility because they are not playing.

Personally, I think it's crap to force a bet on a player, like the occasional 3CP tables who say you must bet the Ante to play the Pair Plus. Or better yet, you must play the Pair Plus to bet the 6 Card Bonus/Millionaire Maker. The bets are independent; let the player choose how to spend their money.
