Hi all,

I am wondering if anyone knows whether a company like Shufflemaster would make agreements where they have rights in certain areas, but in other areas I am free to market my game independently. The reason I ask is that I believe it makes sense to work with a company that can give a game it's best chance of success, but I would also like some upside potential of working independently. Thanks in advance for any thoughts on the matter.

doubt it. im sure they would want exclusivity.

A lot would depend on how good your concept was and in which area you would wish to retain exclusivity.

In business and in life, everything is negotiable.

But it really depends upon who is in the driver's seat.


I.E. If you have successful installs, or even a very good concept, and ShuffleMaster comes to you wanting to purchase it, you're in a position to make specific exclusions. However, if you have nothing but a concept and are trying to get someone like ShuffleMaster to buy it from you, you've got much less bargaining power.

ShuffleMaster agreed to have the rights to Three Card Poker excluding United Kingdom. It was a success at the time albeit in legal mess. Ask yourself if you were a big company having the rights only in certain market makes sence for you. I doubt it.

Anything is possible but the upside for them is not as great as the risk and effort they need to make. Bite the bullet and give them what they want or go on your on. Both path has its own risk and rewards.

Distributors sometimes allow one state, or the original install area, that a developer first installed his game into to remain with the developer, when signing a new contract for the rest.

Contracts can stipulate anything agreed upon. However, if you're a new game designer with no real install base, you may be offered a "take it or leave it" contract agreement.
