Not just on line Poker but also slot machines and table games. Legislation signed.
The only requirement is the "casino" must exist within the state of Delaware and all participants must be citizens of Delaware having ISP addresses in the state of Delaware.
So the virtual slot machines must be on servers inside Delaware and the virtual table must be inside Delaware and all the players must log on from inside Delaware.

Casino games will be available to Delaware residents through the websites of the state’s casinos, with betting controlled and monitored by the state Lottery Office. The state hopes to provide online casino gambling by 2013, with access also available via computer tablets and smartphones. (Office workers should probably check with the boss before laying casino bets on the office computer.)

Interesting. That raises a lot of questions. It also upends the most common aspect of state sponsored gaming. Usually you want as many gamblers as possible to be outsiders.

Actually the politicians usually just want the tax revenue and don't much care where it comes from. Well, Governor Rendell of PA repeatedly made the argument that Pennsylvania residents were going to gamble anyway, and the money should stay in PA rather than go to NJ. But the state is very happy to turn the tables. Bethlehem Sands gets half of its revenue from NJ and NY residents.
But criticism of the program in Delaware will increase as you find homeless people in the public library gambling on the computers.
I am a little surprised at the residency requirement. I really thought these online laws would allow a state to pick up money from someone visiting with his I-PAD.

I would imagine that the program will start out quite conservatively blocking library access and requiring actual ISP addresses and disclosure of physical addresses.
Later on they can deal with problems about under age gambling, out of state "visitors" and library terminals.
