I hope this is the right place to ask my question and if not I would ask the mod to move it. now my question:

I want to offer the following game to my blog visitors and maybe to my facebook friends. I want to offer them a free guess of the 5 numbers of the next
New York Take 5 numbers. and if a visitor hits all 5 numbers he will get a small price or amazon gift card.

would this be legal? any answer and help is very much appreciated.

thank You for the link. always helpful. but for me the most important question is if I could get problems from New York Take 5 organizer?
I just want to have a fair outcome so no one could say that I was cheating.

You are free to make up your own, rather than depend upon an extant game. Maybe 4 of 31 for example. I would not want to stand-out doing what you propose.

I dont know about the legal specifics of this, but if you want to do what you propose, the realistic probability of you having a problem as a result is 0.

Do you think the new york lottery gives a crap about someone giving away a gift card based on their drawing?

I thought the same as you that New York lottery will give a crap...............but I thought I will ask if their numbers are actually their sole property.

I don't think there's an answer to this.

They do generate the numbers, but they publish the numbers publicly.

If you used the numbers to run your own lottery, you would get charged with something related to illegal gambling. The charges would be the same as if you generated your own numbers.

I don't think there's ever been a court case about whether state lottery numbers are the sole property of NYS Lottery or not. And I don't think there ever will be. Without precedent there's no answer to that question.

thanks again for trying to help. that would mean for me to do it and wait till I get a warning. a warning would be acceptable but a court case :(
or
maybe I should mail them and ask if there would be a problem if I use their numbers in a free guess the numbers game

I think if its something thats free to enter you're fine. Good Idea, what's your FB link? What are you selling/advertising?

I hope you are right. as soon the game is on I will post the link if it is allowed here. I am not selling anything I try to get many visitors and add later some ads.
