I don't know how much it will really affect things. For one thing, the burden of proof is there, and how does he prove he was drunk? Blow a breathalyzer? Casinos don't get to be billion-dollar enterprises without weaseling out of some stuff. I wouldn't be surprised if the top lawyers for the casino pull something out of their...ahem, hats.

Much as I agree with the sentiment of personal responsibility there is also the responsibility of the casino. The law says they cannot serve patrons who are too drunk and in the same spirit of bartenders who serve drunk drivers the casinos are responsible. Maybe if they start having to actually follow the law they'll start being responsible.

Play craps instead: it's drunk-proof. You can't bet the passline any worse drunk than sober, and if you're too drunk to stand, you can't play at all (and therefore can't lose any more money).

If he knows that 13+6 = 19, he can't be that drunk. He's doing better than a lot of blackjack dealers.

A ruling of this nature against a casino would cripple the casino industry. Every patron to lose money would claim to have been over served and the casino would have to start administering tests, breathalizers, as well as the old fingers to nose and walking a straight line, to determine that patrons were safe to play, just to cover their ass.
Where is the personal responsibility today. If you drink, get drunk, and lose control and all your money, that's on you. Don't go crying for your money back. But, I wouldn't mind seeing the casino industry be held a little more to the bar/club over serve standard and law and start to get some fines for clearly allowing over served patrons to continue to both drink and gamble.
And by the way, how do these drunk fools lose? Every drunk goofball, I have encountered seem to win. They double down on hard 14 and draw a 6. Stand on their 12 against the dealer 10 and the dealer breaks. Even ridiculous plays like standing on 3, 4 and guess what the dealer breaks. Someone upstairs always seems to be smiling on the drunks that I see. lol
It's because when a drunk stands on 12 vs. 10 and the dealer busts, it's extremely memorable and is seared into your long-term memory. When the drunk stands on 12 vs. 10 and loses, you forget about it almost immediately.

I tend to think here that casinos should take more responsibility for what people do on the floor while gambling. If a person is too drunk to continue then Security should escort them to their rooms or out the door. If the person is too drunk to be left alone then they should be taken to a restaurant, sat down and given some coffee.
I have been in casinos almost all my life and I have seen some disturning images of drunk people. In my opinion casinos have much more to lose by allowing the person to gamble than what they do when asking the person to leave.
Bad press, lawsuits, other unhappy customers, fighting, more lawsuits, the cost of replacing layouts, move lawsuits.....
Just take care of your guests and be responsible......would be my opinion.
Perhaps no drinking on the casino floor or while gambling? You can drink all you like in restaurants, clubs and so on? Just a thought, which, like smoking will never happen of course!
