I hope it doesn't prevent them from doing business with them in the future. Sounds like this could result in a nasty fight with an ending relationship.

I read all that thinking it was going to be some big $$ amount then boom only 15k ! Am I missing something or is the commission on leasing these games that low?

That item popped up on my news feed, so I already sent Dan an email.

I wasn't gonna post it here because I honestly don't know if this is good or bad. I mean, on the surface it sounds bad, but...? So why air potentially dirty laundry?

Regarding the $15K seeming like a low number: This isn't like a personal injury lawsuit where you can claim millions for all sorts of 'pain and suffering' and such. This is merely one company suing another company over a paperwork and payment dispute. OK, It's something of a David & Goliath sort of thing, but maybe by asking for a reasonable amount, it can get settled quickly.

Go Dan! I took on a giant one time and won. I owned an auto glass business and Farmers always short paid, even after approving the amount before the work was done. Nobody wanted to challenge them as it was kind of the hand that feeds you situation. I said screw that, it's wrong. I sued and their attorneys settled about 10 minutes into negotiations.

Don't let them take advantage of you!

$15,000 is almost certainly the minimum grievance amount to file a lawsuit in the court and pretty much means nothing as a dollar figure but getting a foot in court. I'm sure he'll win, otherwise the company wouldn't bother deceiving him.

You read about these type cases usually about music royalties that go back decades, because the victims are usually deceived or sold out and it seems so here. If they're lying about the machines, maybe they're lying about the tables too. Shameful how wicked these big companies are lying, cheating and stealing like they tend to do. Wish they would break up all these mergered companies.

Sorry to hear this, Dan. In cases like these, it's the lawyers that always win. But Dan is very knowledgeable and I hope he can set a precedent for the future. Good luck fighting them.

How did one find out how many placements of his game are out there? He has to visit many casinos and take pictures. Casinos wont tell and from time to time, they move game in and out.....

Asking for $15 k? The legal fee can easily be $10 k....

Depending on how long the dispute goes, you're off by at least an order of magnitude.

I think they're asking for 15K in ADDITION to the actual royalties owing (which still need to be calculated accurately).

As someone else mentioned, the 15k is just to get the right jurisdiction. Anything under 15k can't be heard by NV District Court:

I scanned the article, so forgive me if I'm getting this wrong... but is Dan basically saying the casino isn't paying them properly for their licence on the game??

No.

He's saying ScientificGames (ShuffleMaster) isn't paying and/or not reporting properly.

Eh, for the sake of pure irony I'm gonna go ahead and count that... The guy that praises the casino industry for always doing the 'right' thing, getting the shaft from a major player in the casino industry...

Dan, perhaps you didn't adhere to one of their "unwritten" but well "understood" rules?

I read Dan praised casinos, but not and never "distributors". He was let go from one distributor after having invented some of their games. That is, distributor need sales (on the payroll) not inventors (on the payroll).....

I don't think his issue is with a casino, but rather that there are more machines or copies of his software out there, in multiple casinos, than SG is accounting for. By a significant multiple.

I don't agree with Dan's point of view on AP play, but a contract is a contract.

Just like the implied contract I have with the casino: to only use my brain to decide how to play blackjack.

Philosophical differences aside, he deserves to get paid. Hope it works out.

Distributors need sales, sure. But they also need something to sell. Toward that end, Dan was doing a fine job. There's probably more to the "let go" story than meets the eye, as there are at least two sides to every story.

Nobody likes Shuffle Master. Not Casinos, not inventors, not other distributors. Unless you work for them or with them. Then you have to.

Distributors fill a role, but it is the casinos who are at the forefront where players met the product. In my book, I had fine words for all distributors and their products, as well as for the many individual game inventors and their products, discussing here many good products and mentioning all by name.

I'm on fine terms with Galaxy, friendly with many there. I completed what they needed, and left on good terms. To the best of my knowledge, they didn't hire, place, or fill the position; they're getting the stuff out and are doing well. Once having a full portfolio of offerings, they need to spend on producing sales, maintenance and distributing from that point. Most distributors promote the acquired/leased products many independents do.

Yeah, I"m gonna side with the distributor. They seem nice and have never wronged me... So that means they could never wrong anyone else. Dan must have been doing something he 'had a hunch' they didn't like and they were probably within their right to act as they did.

(does this sound silly? ...that's how all of us feel every time he sticks up for the casino industry mistreating counters/AP's)
