In this situation it is probably pretty likely that the driver if he were a human would not be charged or considered at fault LEGALLY.
But I have driven in and around major cities for decades. And I can tell you this kind of thing has happened to me many, many times. And I've always been able to stop. If I was driving that car based on what I saw on that video:
THERE IS ABSOLUTELY NO WAY I WOULD HAVE HIT THAT PERSON
the challenge that driverless car makers face cannot just be to make sure the car does not commit a legal infraction
the bar has to be a lot higher than that

Wow, I don't know much about how those cars work, but I don't think any court in the world would find fault with the driver if was a regular car. What on earth was that woman doing crossing the middle of a highway at night???
